This defense was logical and well-founded, and the public prosecution authority surprisingly could not refute it. In the end, with advice from an expert, the public prosecution authority took another route and chose to charge Zhang San with picking quarrels and provoking trouble.
According to criminal law, any behavior that fabricates excuses to cause trouble or causes trouble for no reason can be judged as picking quarrels and provoking trouble. Zhang Sanās action of smashing the glass was clearly causing trouble for no reasonādeliberate destruction. Obviously, it could constitute picking quarrels and provoking trouble. The charge of picking quarrels and provoking trouble has no monetary value requirement. And its sentencing is under five years, whereas the crime of vandalism carries a sentence of merely under three years of fixed-term imprisonment. This legal maneuvering ultimately backfired.
